Feb 27, 2023 (newstodate): EU and Japan have agreed on a new Air Services Agreement to spur open and fair competition between airlines on both sides.
The agreement follows on the judgements of the Court of Justice in the so-called “Open Skies” cases in June 2003, when the Council authorized the Commission to open negotiations with third countries on the replacement of certain provisions in existing bilateral air services agreements by an agreement at Union level.
The agreement will give all EU carriers non-discriminatory access to routes between the EU and Japan, thereby promoting open and fair competition. It will replace the existing provisions in 13 bilateral air services agreements between member states and Japan, bringing existing bilateral air services agreements in line with Union law.
The agreement will now be forwarded to the EP for consent before returning to the Council for its conclusion -, and then take effect on the first day of the next month following the date of receipt of the latter notification.
