Dec 04, 2012 (newstodate): Swissport will indeed pursue its issue with JV partner Ukraine International Airlines if the court verdict on its appeal case favors its opponent.
The case at Ukraine's second court level will open on December 10, 2012, with judge Chorna L.V. presiding.
-If this second court verdict still supports the claims by Ukraine International Airlines and its owner, Mr Aron Mayberg, Swissport will indeed refer the case to the third and final level, says Mark Skinner, Swissport VP Business Development and Projects, Division Europe, Asia, Africa and Middle East.
Earlier Remo Hanselmann, Key Account Manager at Swissport's media bureau, Hans Mars, told newstodate that Swissport would not refer the case if the second-level verdict would still support the claims by UIA.
-If the second-level court also supports the allegations made by Mr Mayberg, we may probably have to divest of our shares altogether as a renewed hearing at third court instance would probably not change the picture in our favor, Mr Hanselmann said earlier.
After UAI was taken over by Israeli national Aron Mayberg in 2011, Swissport Ukraine has been targeted by what it terms "a hostile corporate raider attack" by UAI and Mr Mayberg who claim that their minority rights have been violated by a suggestion from Swissport to recapitalize the JV.
UIA thus claim a right to take over the entire stake held by Swissport at a share price sharply under what Swissport estimates to represent real value.
