Nov 28, 2012 (newstodate): A date has now been set for hearing at the second court instance of the dispute between Swissport and Ukrainian International Airlines over their Ukrainian handling joint-venture.
Swissport has thus been informed that the court hearings in the Kyiv Economic Court of Appeal regarding the appeal of Swissport International Ltd. on the verdict of the court of the first instance are scheduled on December 10, 2012, with judge Chorna L.V. presiding.
Swissport Ukraine launched business from June 1, 2006, at Kiev Boryspil Airport in a JV with Ukraine International Airlines holding 30 percent of the shares.
A rift has however developed after a Board Meeting on March 6, 2012, when Swissport raised the issue off the formal agenda of a future recapitalization of the JV.
While this was allegedly raised as a topic for discussion after the formal agenda only, UIA's owner since 2011, Israeli national Aron Mayberg claims that the carrier's minority rights have been violated while Swissport Ukraine claims it has been targeted by what it terms "a hostile corporate raider attack" by UAI.
At the hearing at the first court instance Mr Mayberg's claims were supported by the judge, causing Swissport Ukraine to file an appeal at the second court instance.
- If this court also supports the allegations made by Mr Mayberg, we may probably have to divest of our shares altogether as a renewed hearing at third court instance would probably not change the picture in our favor, Mr Hanselmann, Key Account Manager at Swissport's media bureau, Hans Mars, earlier told newstodate.
Despite repeated calls by phone and email, newstodate has not been able to obtain any comment on the issue from Ukraine International Airlines
